TERMS & CONDITIONS

1. Scope and Acceptance

These Terms apply to the GOFLX EV website, vehicle rental and battery-swapping services. By booking, renting or using a vehicle, the Rider agrees to these Terms and the plan details shown before payment. Any separate rental confirmation or vehicle handover record also applies. The Rider may contact GOFLX before booking with questions.

2. Eligibility and Legal Compliance

The Rider must be at least 18 years old and provide accurate information. The vehicle may be used only in accordance with its actual certified category and applicable law. Any driving licence, registration, helmet, insurance or other requirement that applies to the particular vehicle must be followed. These Terms do not create a legal exemption.

3. Plans, Prices, Taxes and Swapping

Current plans: Weekly — ₹1,799 for 7 days; Monthly — ₹7,500 for 30 days. Standard battery swapping is included in these plans, subject to station/network availability, provider rules and any limits disclosed before payment. GOFLX will display or communicate the applicable price and taxes, if any, before payment. Changes will apply to a new or renewed booking after the updated price is disclosed and accepted.

4. Booking, Payment and Rental Period

The rental period, vehicle allocation, payment method and any additional charges will be confirmed at booking or handover. Pay only through payment methods officially authorised by GOFLX and retain the receipt or transaction confirmation. Do not pay an employee or third party unless GOFLX has expressly authorised that method and provides an official receipt. Renewal is not automatic unless clearly disclosed and separately authorised.

5. Security Deposit and Refund

The stated security deposit is ₹1,800. After the vehicle, keys and accessories are returned, GOFLX will inspect the vehicle and reconcile the account. The deposit will be refunded after deducting only unpaid amounts properly due and reasonable, documented costs for rider-caused damage beyond normal wear, missing accessories or penalties legally attributable to the Rider. Any deduction will be explained. No automatic deposit forfeiture or deduction will be applied unless a lawful, reasonable charge has been clearly disclosed before booking and accepted. Refund processing time will be communicated to the Rider.

6. Cancellation and Early Return

The Rider should check the cancellation and refund terms displayed for the selected plan before payment. Returning the vehicle early does not automatically entitle the Rider to a refund of unused rental fees unless the plan terms, a written confirmation or applicable law provides otherwise. Any applicable cancellation or early-return charge must be disclosed before booking and must be lawful and reasonable.

7. Handover, Care and Return

At handover, the Rider should check the vehicle, tyres, brakes, lights, battery indicator and accessories and report any existing issue immediately. The Rider must return the vehicle, keys and supplied accessories at the agreed place and time, keep the vehicle reasonably secure and not sell, sub-rent, transfer or allow an unauthorised person to use it.

8. Maintenance, Damage and Tyres

GOFLX is responsible for routine maintenance and ordinary wear from normal use. The Rider may be charged reasonable, documented repair or replacement costs for damage caused by misuse, negligence, reckless riding, collision, overloading, tampering, unauthorised repair or failure to report a known fault. Rider-caused punctures, cuts or abnormal tyre damage are the Rider’s responsibility when supported by the circumstances and inspection. Normal tyre wear from ordinary use is GOFLX’s responsibility. Charges will reflect reasonable actual costs and applicable law.

9. Battery Care and Swapping

The Rider must monitor the battery level and arrange a swap when it reaches 10% or earlier. Do not intentionally or negligently continue using the vehicle below 10%; a very low charge may affect battery operation or trigger a protection mode. Since swapping is included in the plan, the Rider should swap promptly. If the indicator appears faulty or a swap is unavailable, contact GOFLX promptly and follow safety instructions. Battery damage charges may be imposed only where the damage is reasonably attributable to the Rider and the charge is documented and lawful.

10. Safe and Prohibited Use; Triple Riding

Triple riding (three people on the vehicle), overloading, racing, reckless use, towing, tampering, unlawful use and unauthorised sub-rental are prohibited. The Rider must not ride under the influence of any impairing substance, use a phone in a way that distracts from riding, or continue riding a vehicle known to be unsafe. A ₹2,500 amount may be claimed for a proven triple-riding incident only to the extent it represents reasonable compensation permitted by law, taking account of the circumstances and evidence. Any official government challan is separate and payable as required by law. The stated amount is not an automatic or guaranteed penalty where law does not permit it.

11. Late Return and Recovery

The Rider must return the vehicle by the agreed time or obtain an extension in advance. A disclosed late fee of ₹100 may apply for a late return, subject to applicable law and the booking terms. If the Rider fails to return the vehicle as agreed and GOFLX sends staff or a recovery team, GOFLX may seek reasonable, documented recovery costs, up to ₹2,500 per visit where lawful and proportionate to the actual circumstances. No term authorises threats, unlawful force or unauthorised entry. GOFLX may use lawful recovery or reporting procedures.

12. Traffic Challans and Other Fines

The Rider is responsible for traffic, parking, toll and online/e-challans arising from the Rider’s use during the rental period, to the extent legally attributable to the Rider. GOFLX will provide available challan details when seeking reimbursement. If a challan arrives after the rental ends but relates to the Rider’s period, the Rider must reasonably cooperate and pay the amount legally attributable to them. The Rider is not responsible for unrelated violations before handover or after return.

13. Accident, Theft, Breakdown and Insurance

The Rider must promptly notify GOFLX of an accident, theft, breakdown or damage and contact police or emergency services where appropriate. The Rider must cooperate with reasonable incident documentation and any applicable insurance process. Insurance coverage depends on the actual policy, exclusions and facts of the incident; GOFLX does not promise that every loss is insured. Responsibility will be determined by the facts, policy and applicable law.

14. KYC, Privacy and Records

GOFLX may request identity, age, address and contact information reasonably necessary for onboarding, rental administration, safety and legal compliance. Information will be handled under the GOFLX Privacy Policy and applicable law. GOFLX may retain relevant booking, payment, vehicle-condition and acceptance records for legitimate operational and legal purposes. Never share Aadhaar OTPs or authentication credentials. Third-party reference details should be provided only where lawful and appropriate.

15. Service Availability and Support

Vehicle availability, battery swapping and support depend on station operations, network coverage, technical conditions and third-party provider availability. GOFLX will make reasonable efforts to provide the service described in the selected plan, but cannot guarantee uninterrupted availability at every station. If a swap fails or the vehicle seems unsafe, contact GOFLX and do not continue unsafe use.

16. Suspension, Termination and Liability

Subject to applicable law, GOFLX may suspend or end a rental for non-payment, material breach, safety concerns, false information, unauthorised use or legal requirements. The Rider must return the vehicle and pay lawful outstanding amounts. Nothing in these Terms excludes a right or liability that cannot legally be excluded, including non-excludable consumer rights. Any claim for loss or damage must be assessed under applicable law and supported by relevant facts.

17. Changes, Complaints and Governing Law

GOFLX may update these Terms for future bookings and will disclose material changes before applying them to a new or renewed booking. These Terms are governed by the laws of India. Disputes may be brought before a court or forum having jurisdiction under applicable law; nothing here removes a consumer’s statutory rights or limits a forum’s legally granted jurisdiction.
